In general terms the firm is a general practice firm, it is fully conversant with various securities available to financial institutions and other companies within Uganda. It has played and is playing a significant role in advising, drawing, and registering of various securities for its client banks .
The firm has been engaged inter alia, extensively in major project finance where loans, suppliers and buyer\'92s credits and other facilities have involved lending institutions and credit guarantee agencies from a wide range of diverse jurisdictions . We have acted for many of these institutions and agencies both in the private sector and in connection with commercial loans.
In Uganda legal fees are calculated according to the Advocates Act (No. 22 of 1970) the Advocates (Remuneration and Taxation of Costs) (Amendment) Rules, (Statutory Instrument no. 3 of 1996). A copy of the said Rules is hereto annexed for your ease of reference. Under these Rules one would elect to charge on percentage basis where the value of the subject matter can be ascertained in monetary terms. Alternatively, one would elect to charge or calculate fees on an hourly basis.
Our approach is both flexible and transparent but within the confines of the professional rules and regulations . Where permissible by the Rules we negotiate and agree with the client on the appropriate method of calculating fees.
Our rates are inclusive of all over heads and administrative expenses and all taxes payable by Magezi, Ibale & Co. Advocates. Legal firms are subject to Value Added Tax (VAT) on fees at the rate of 17% on the fees.
The charges will not include out of pocket expenses such as travel, accommodation and subsistence allowance out of Kampala, they do not include disbursements like photocopying, production of documents, telephone charges, faxes and government fees.
If appointed we would propose an initial deposit on account. The funds will be fully accounted for against the work carried out. Thereafter fee notes will be raised at the end of every month for work done and would expect that they are paid within fifteen (15) days after delivery. We are also open to consider any reasonable proposal as to other modes of payment.
